The CPCC started the new year off by filing a successor petition for post-conviction relief yesterday evening. The U.S. District Court for the Southern District of Mississippi had stayed this case so that our client could seek review in the Mississippi Supreme Court.
As the federal court explained in its stay order: "Given the seriousness of the issues involved in this case and the state court’s obvious concern over some aspects of the trial, this Court is of the opinion that the Mississippi Supreme Court should be given an opportunity to review these claims, as well as any other issues that the state court believes merit its consideration.”
